To my representative in Congress,

        I am writing or calling you today to encourage you to vote for HR 2454,  the Waxman- Markey energy bill. With an average cost per household of only $1500 per year this legislation is a real bargain. In these booming economic times I'm sure that every one of your constituents will be glad to pay alittle bit extra for a tank of gas and their monthly electric or gas bill.  Of course every thing that we purchase that uses electricity from light bulbs to lawnmowers to automobiles will cost a little extra as well.  And let's not forget that if by any product that uses energy to be produced (basically everything) will be just a little more expensive.

        We know just from last summers spike in gas prices, that an increase in energy costs might cause a few of your constituents to lose their job.  With the job market as strong as it is, these folks should have no problem at finding a new job.  Heck, they'll probably appreciate having some time off to relax. Of course paying for a tank of gas or keeping the lights turned will be easy to pay on those big unemployment checks!

        Let's not forget the long term economic benefits of this wonderful legislation.  I can't believe that the Congressional Budget Office didn't even factor in the decrease in GDP. According to the CBO "The resource cost does not indicate the potential decrease in gross domestic produce (GDP) that could result from the cap." If we are all making less money then we pay less in taxes ... right?  So in way this isn't really a tax increase.  We make less, we pay less,  I'm sure that somehow Congress can make that a tax cut!

        Since the government is now competing against private enterprise in the automotive industry, I sincerely hope that Government Motors General Motors will be given some sort leeway on meeting the requirements imposed by the legislation. This will will give them a great advantge over those other evil private companies. Those folks who work in manufacturing plants or dealerships for other manufacturers better get on the ball if they want to compete!  Right?  Even if GM doesn't have any special advantage, those folks better shape up or prepare a resume!  I'm sure the economies of Ohio, Michigan, and other auto producing states will be be ble to provide plenty of good paying jobs for those lid off workers.

Powder Springs, ga. : A local Powder Springs chef has been cooking up big things! Rian MacDonald has already published his first cookbook. I first met Rian and his wife Lauren(for more about Lauren, see my recent post "Is there Hope For Public Education") at a chili cookoff here in our neighborhood and we have become great friends since that time. 

Do you know what's the best part of knowing a chef who is writing a cookbook? He cooks the food to take pictures and somebody has to eat it!  I have tasted most of the recipes in the book and every one of them is totally awesome!

We check the tenants credit.. How about the landlord?

More and more often I am getting calls from people who are renting their homes, paying the rent on time, and then find out that the landlord has not been making the mortgage payments. The situation is even worse if the caller was in a lease purchase arrangement and put up $thousands$ for the chance to buy the home.

In almost every situation the caller/tenant has no choice but to move.  If they have put up extra money toward a lease purchase they will lose it.  Their security deposit is gone.  Oh sure they could sue the landlord and win.  But so what.  The landlord has no money and then the tenant has to try to collect.  Maybe if the landlord has a job they can get a garnishment.  That is if the landlord doesn't go bankrupt.

I do a little tenant representation but I wouldn't consider myself an expert in this area of real estate.  But what can tenants or prospective tenants do to protect themselves? My basic proposal would be for the landlord to provide a copy of each months mortgage statement to the tenant showing that the payments are current. The landlord can blackout some of account numbers and personal information.  Just leave enough so that the resident knows it is the statement for the home they are living in.  This would create a more equilateral relationship between the tenant and landlord.  The landlord recieves the rent each onth so they know the tenant is current.  The tenant recives a mortgage statement each month so they know the landlord is current.

For the agents out there reading this, what would you do to protect a tenant?  Are there any clauses in your leases or any special stips that you have seen?

How about suggestions for tenants that find themselves in this situation?

Coaching Students To Stay In School

The South Atlanta Educational Complex is a vast brick-and-glass building housing 1000 or so 9th- through 12th-graders. While its students look like those from any big-city school district, administrators estimate that about 85% come from families whose income is below the federal poverty line. In addition to getting an education, many of these teens are supporting a child or younger siblings or caring for an elderly relative or sick parent. Some are in foster care, and some are homeless. Others are children of recent immigrants who work long hours and don't know how to help them thrive academically.

So just what is that customers wants from their vendors and suppliers?

I think this video "hits the nail on the head".  The video deals with all vendor/client relationships but as you'll see, it will be very familiar stuff for those of us in the real estate industry :-)
